Brussels moved ChatGPT into the same regulatory tier as a social network on Monday. The European Commission handed OpenAI’s chatbot, along with Reddit and Roblox, the Digital Services Act designation reserved for the largest platforms, which carries the bloc’s strictest safety duties. The designation applies once a service exceeds 45 million monthly active users in the EU, a threshold each of the three companies has now crossed. Compliance is due by the close of December, and missing it exposes each company to penalties reaching 6 percent of worldwide revenue.

Two duties come attached in particular: take illegal material down, and keep minors private and safe on the service. For ChatGPT, this is the first time a general-purpose chatbot has been regulated as a platform to be moderated, rather than as an AI system to be evaluated for capability or risk.

That distinction is the real story. The EU’s AI Act governs ChatGPT by classifying the underlying model’s risk tier and reviewing what the system can do. The DSA instead treats ChatGPT as a distribution channel, the same legal category applied to Facebook or YouTube. The DSA’s obligations are also active now, months ahead of the AI Act’s general-purpose model provisions, which makes this the compliance deadline that lands first and carries the sharper enforcement teeth.

Henna Virkkunen, who runs technology policy for the bloc, said the three services “will now be held to a higher standard of scrutiny and accountability in the European Union, in line with their large impact on our citizens and society.”

This is not Brussels’ first attempt to fold an AI product into the DSA. X’s chatbot Grok is already under a DSA investigation, and that probe has not yet produced a public enforcement outcome. Whether the ChatGPT, Reddit, and Roblox designations produce fines or years of procedural review is the question the December deadline will start to answer.

The user threshold is also notable for what it does not require. No finding of harm and no specific complaint triggers the designation, only scale. Any AI product that crosses 45 million monthly EU users now inherits platform-level obligations, regardless of whether it looks like a chatbot, a forum, or a game.

For any AI company building a consumer product with European reach, the practical lesson is a number to track, not a court to fear. Cross 45 million monthly EU users and DSA obligations apply on a fixed clock, independent of whatever the AI Act eventually requires for the same model. Teams planning EU growth should price DSA compliance into that expansion, not treat it as a later problem.
